Public Offer to Conclude a Contract for the Provision of Services
User Agreement of the "Fortochka" («Форточка») service. Edition of 14 October 2026.
This document is an offer by Султыгов Сандро Ниясович, a natural person applying the special tax regime "Tax on Professional Income" (INN 151211100811, city of Грозный), hereinafter the Provider, to conclude a contract for the paid provision of services, on the terms set out below, with any natural person who meets the requirements of clause 1.3. Under paragraph 2 of Article 437 of the Civil Code of the Russian Federation (hereinafter the Civil Code), this document is a public offer (hereinafter the Offer). The Offer also contains the terms on which a new User is given a period of use of the Service without payment (section 7). The Offer together with the Plans and the Refund Terms (clause 1.15) makes up the user agreement of Fortochka; in the Bot these documents are opened with the "User Agreement" («Пользовательское соглашение») button.
1. Terms and definitions
1.1. Fortochka (in the Russian text: «Сервис») means the "Fortochka" («Форточка») service through which the Provider provides the Service.
1.2. Service (in the Russian text: «Услуга») means giving the User, for a fixed term, the possibility of transmitting data between the Device and the Provider's servers in encrypted form when working on the Internet. The Provider does not provide access to the Internet: the User obtains it from the User's own telecommunications operator (clause 2.4).
1.3. User means a natural person with full legal capacity who has reached the age of 18 and who uses Fortochka for personal, family, household and other needs not connected with business activity.
1.4. Bot means Fortochka's program in the Telegram messenger, available under the name @get_fortochka_bot. Mini App means Fortochka's application that opens from the Bot inside the Telegram messenger.
1.5. Site means the Provider's website on the Internet. Until the Site is opened, the documents of Fortochka are placed in the Bot and are permanently available there through the buttons "Plans and prices" («Тарифы и цены»), "User Agreement" («Пользовательское соглашение»), "Privacy Policy" («Политика конфиденциальности») and "Support" («Поддержка»); everything that the Offer, the Plans, the Refund Terms and the Policy say about placing and publishing documents on the Site applies, until it is opened, to their placement in the Bot.
1.6. Plan means a term of the Service in days and its price.
1.7. Order means the User's request to pay for the chosen Plan, created in the Bot or the Mini App.
1.8. Paid Period means the number of days of the Service paid for under one Order.
1.9. Free Period means the trial period or the invitation period, which are given without payment and are described in section 7.
1.10. Extra Days means days of the Service that are credited under the Invitation Programme (section 8).
1.11. Access Term means the total term during which the Service is available to the User. It is made up of the Free Period, the Paid Periods and the Extra Days.
1.12. Device means a device from which a connection is established.
1.13. Payment Service means the Platega payment acceptance service through which the Provider accepts payment.
1.14. Support means the ways of contacting the Provider: Telegram @get_fortochka_bot and e-mail reach_fortochka@mail.ru.
1.15. The documents "Plans and Payment Procedure" (hereinafter the Plans) and "Terms of Withdrawal from the Service and Refund of Money" (hereinafter the Refund Terms) are published on the Site and form part of the Offer. The "Personal Data Processing Policy" (hereinafter the Policy) is published on the Site as a separate document of the Provider.
2. Subject of the contract
2.1. The Provider undertakes to provide the Service to the User during the Paid Period, and the User undertakes to pay for the Service under the chosen Plan.
2.2. During a Paid Period the Service may be used on no more than 3 Devices at the same time. The volume of traffic is not limited, subject to fair use (clause 9.3).
2.3. Data between the Device and the Provider's server are transmitted in encrypted form, for example when connecting through public wireless networks (Wi‑Fi). On the stretch from the Provider's server to a website or service on the Internet, data are transmitted in the same way as with an ordinary connection.
2.4. To use the Service, the following are needed:
— a connection to the Internet, which the User obtains from the User's own telecommunications operator independently and at the User's own expense; — a Device with an operating system from the list given in section 1 of the Plans; — a connection application on the Device. The application is published by third parties; the Provider charges no fee for it.
The User receives the connection details in the Bot and the Mini App.
2.5. The Provider provides the Service personally, using servers rented by the Provider.
2.6. The Service is not intended for acts that violate the legislation of the Russian Federation or for assisting such acts. The Service is not intended for access to information resources access to which is restricted in accordance with the legislation of the Russian Federation, and must not be used for that purpose. Access through the Service to particular information resources may be restricted in the cases established by law.
3. Conclusion of the contract
3.1. The contract for the provision of the Service for a fee is concluded by acceptance of the Offer. Acceptance is payment of an Order created by the User in the Bot or the Mini App (paragraph 3 of Article 438 of the Civil Code). The acceptance is full and unconditional.
3.2. The contract in respect of an Order is deemed concluded at the moment the User pays that Order. The moment of payment is the moment when the User's bank confirmed execution of the User's instruction to transfer the money. The Provider learns of the payment from the Payment Service's confirmation.
3.3. Each Paid Period is governed by the editions of the Offer, the Plans and the Refund Terms that were in force when the relevant Order was created. A Free Period is governed by the edition of the Offer that was in force when it was requested.
3.4. Starting the Bot, viewing the Site, silence and continued use of Fortochka are not acceptance and create no obligation to pay anything. Receiving a Free Period is not acceptance as regards payment and creates no such obligation either; the terms of use of the Service during a Free Period are set by clause 7.7.
3.5. The Service is provided only to persons who have reached the age of 18. Before first using Fortochka, the User declares, by a separate action in the Bot or the Mini App, that the User has reached the age of 18.
3.6. The prices and the terms of the Offer are the same for all Users.
3.7. To protect Fortochka against misuse, technical limits apply: one Telegram account may have no more than 6 unpaid Orders at the same time and no more than 30 Orders per day. An unpaid Order is cancelled 24 hours after it is created. If there are already 6 unpaid Orders, the earliest of them is cancelled when a new Order is created. These limits are not a refusal to conclude a contract: after Orders are paid or cancelled, new Orders are created in the usual way.
4. Plans and price
4.1. The terms, prices and content of the Service under each Plan are stated in the Plans.
4.2. The price of a Plan is stated in roubles and is the full amount the User pays with either payment method. No fee for accepting the payment is charged to the User on top of the price. No VAT is charged: the Provider applies the special tax regime "Tax on Professional Income".
4.3. The price of an Order is fixed at the moment it is created and does not change for that Order.
4.4. A change to the Plans applies only to Orders created after the new edition of the Plans is published. A Paid Period is not recalculated.
5. Payment procedure
5.1. Payment is accepted through the Payment Service by one of these methods: through the Faster Payments System (SBP) by QR code (a graphic code for payment), or by a bank card issued by a Russian bank.
5.2. The User enters the payment details on the Payment Service's side. The Provider does not receive or store bank card data.
5.3. Each payment is a single payment. There is no automatic renewal, payment details are not saved for later charges, and no money is charged without a new Order created by the User.
5.4. After the payment is confirmed, the Provider issues a receipt in the «Мой налог» ("My Tax") application and sends the User a link to the receipt in the Bot chat.
5.5. If money has been debited but the payment of the Order is not shown in the Bot, including where the payment arrived for an Order that had by then been cancelled (clause 3.7), the User informs Support. The Provider checks the payment in the Payment Service and, at the User's choice, activates access or returns the whole amount paid.
6. Activation of access and term of the Service
6.1. Access is activated automatically after the Payment Service has confirmed the payment to the Provider, usually within a few minutes.
6.2. The outer time limit for activation is one day (сутки) from the moment the Order is paid. A delay in confirmation on the Payment Service's side does not extend this time limit. If access is not activated within this time limit, the User may withdraw from the Order and receive the whole amount paid. The User's other rights provided by law in case of a breach of the time limit for providing a service remain.
6.3. A Paid Period is counted in full days (сутки). It starts at the moment access is activated under the Order or, if the User has a current Access Term, when the previously added days end: the days of the new Order are added to the end of the current Access Term, and previously received days are not lost.
6.4. The Plan limits (number of Devices, volume of traffic) apply from the moment access is activated under a paid Order, including where the Order is paid during a Free Period. From that moment the Free Period's limits on the number of Devices and the volume of traffic do not apply. If such an Order is refunded in full before the Free Period ends, the Free Period's limits apply again to the remaining days of the Free Period.
6.5. When the Access Term ends, access to the Service ends. The User has no obligation to extend it. To continue, the User creates and pays for a new Order.
6.6. Server addresses and connection parameters may change. The current connection details are available to the User in the Bot and the Mini App.
7. Trial period and invitation period
7.1. A new User, on the User's request in the Bot or the Mini App, is given once, without payment, one of the Free Periods:
— trial period — 7 days, 1 Device, no more than 20 GB of traffic — for a User who started using Fortochka without an invitation; — invitation period — 30 days, no more than 2 Devices at the same time, no more than 50 GB of traffic — for a User who started using Fortochka through another User's invitation link.
7.2. A Free Period is given once per Telegram account. The User receives one of the two periods, but not both.
7.3. The terms of the Free Periods are the same for all new Users.
7.4. A Free Period is given without payment details being provided, creates no obligation to pay for the Service, has no monetary value and cannot be exchanged for money.
7.5. A Free Period ends when its term expires or when its volume of traffic is used up, whichever comes first. If an Order is paid during a Free Period, clause 6.4 applies.
7.6. No fee is paid for a Free Period, so the Offer's rules on payment and on refund of money do not apply to it.
7.7. By requesting a Free Period in the Bot or the Mini App, the User concludes with the Provider a contract for use of the Service free of charge for the term of the Free Period, on the terms of sections 1, 2, 7, 9, 10 and 12–16 and clauses 6.4–6.6 of the Offer — to the extent not related to payment. The User is not obliged to pay under this contract.
8. Invitation Programme
8.1. Every User has an invitation link in the Bot. An invited User is a new User who started using Fortochka through that link. The Provider does not instruct Users to spread information about Fortochka.
8.2. When an invited User has made a first payment and that payment has not been refunded within 3 days (сутки) from the moment of that payment, 30 Extra Days are credited to the inviting User once those 3 days have passed.
8.3. Within any 12 consecutive months, no more than 12 credits of the kind stated in clause 8.2 are made. Credits above this number are not lost: they are made later, when this does not breach the said limit.
8.4. Once, the inviting User is credited with 365 Extra Days — when, at the same time, at least 5 Users invited by that User each have:
— a payment made at least 3 days (сутки) earlier that has not been refunded; — a current Access Term.
8.5. Extra Days are added to the end of the current Access Term or, if the Access Term has expired, are counted from the moment they are credited.
8.6. Extra Days are days of the Service only. They are not money, have no monetary value, are not paid out or compensated in money, cannot be transferred to other persons and are not remuneration for services. Taking part in the Invitation Programme does not make the User an agent, representative or employee of the Provider. The User determines and deals with any tax consequences of receiving Extra Days independently.
8.7. An invitation link may be passed only to people the User knows personally. It is not permitted to place it in publicly accessible sources: in channels and group chats, on websites, in notices, in advertising, in mass mailings. If this rule is breached, the Provider may switch off the User's invitation link and cancel the credits (clause 8.8).
8.8. Extra Days are not credited, and credited ones are cancelled, only in the following cases:
— the invited User's payment for which the credit was made has been refunded in full or in part — the 30 Extra Days credited for that invited User are cancelled; for the purposes of clause 8.4 that invited User is counted only if he or she has another payment that meets the conditions of clause 8.4; — the invited account belongs to the inviting User himself or herself; — the invited account is fictitious or was created automatically; — the invitation link was placed in breach of clause 8.7.
Only Extra Days that have not yet been used are cancelled. It is for the Provider to prove the circumstances that served as the ground for cancellation; the Provider tells the User the reason in the Bot chat. Cancellation of Extra Days does not reduce Paid Periods.
8.9. A change to, or the ending of, the Invitation Programme applies only to invitations made after the changes are published. Extra Days credited earlier are kept.
9. Rules for using the Service and uses that are not permitted
9.1. The User undertakes not to use the Service:
— for actions that breach the legislation of the Russian Federation, including searching for, obtaining and distributing extremist materials and other information whose distribution is not permitted in the Russian Federation, and for committing offences; — for access to information resources access to which is restricted in accordance with the legislation of the Russian Federation; — for sending spam (mass messages which the addressees have not agreed to receive); — for attacks on networks and information systems and other actions that disrupt their operation; — for fraud, for unauthorised access to other persons' accounts, devices and data, or for distributing malicious software; — for infringing the rights of other persons, including rights to the results of intellectual activity; — for exchanging files through peer-to-peer networks — this is not permitted by the rules of the hosting providers on whose servers Fortochka runs; — for reselling access and for connecting Devices above the limit, including by passing connection details to other persons.
9.2. The User alone is responsible for how the User uses the connection.
9.3. Fair use is use of the Service for personal, family and household needs on Devices within the limit and without breaches of clause 9.1. No numeric threshold for the volume of traffic is set for a Paid Period.
9.4. The User does not pass on connection details in such a way that the number of Devices exceeds the limit, and does not give other persons access to the User's Telegram account.
10. Suspension and ending of access
10.1. The Provider may suspend access to the Service only if the User breaches clause 9.1.
10.2. Before suspension, the Provider sends the User a message in the Bot chat that names the breach and asks the User to stop it. In the message the Provider states what information the conclusion about the breach is based on (a communication from a hosting provider or another person, the records of Devices and of the volume of traffic). It is for the Provider to prove the breach. If the breach is not stopped within 24 hours or is repeated, access is suspended.
10.3. If the breach creates a threat to the operation of Fortochka or to the rights of third parties (an attack on networks, the sending of spam, a hosting provider's demand), access is suspended at the same time as the message is sent.
10.4. Access is restored no later than one day (сутки) after the User has told Support that the breach has stopped, or immediately if the breach was not confirmed. The time for which access was suspended is not counted towards the Access Term: the Access Term is extended by that time.
10.5. If the breach was confirmed and the User did not stop it or repeated it, the Provider may withdraw from performance of the contract on the terms of paragraph 2 of Article 782 of the Civil Code, that is, with full compensation of the User's losses. The Provider tells the User the reason in the Bot chat, no later than 7 calendar days from the day of that message returns the cost of the days of the Paid Period not used by the moment access was suspended, and compensates the User's other losses caused by the withdrawal. No fines or deductions are applied.
10.6. If the Provider learns that the User has not reached the age of 18, the Provider stops providing the Service and no later than 7 calendar days returns the cost of the unused days of the Paid Period and, on the demand of a legal representative, the whole amount paid by the minor. This does not limit the other rights of legal representatives provided by law.
11. Withdrawal from the Service and refund of money
11.1. The User may withdraw from the Service at any time after paying an Order — both before the Paid Period starts and during it — without giving reasons (Article 32 of the Law of the Russian Federation No. 2300-1 of 07.02.1992 "On Protection of Consumer Rights", hereinafter the Consumer Protection Law).
11.2. On withdrawal, the Provider returns the cost of the unused days of the Paid Period or, if the Paid Period has not yet started, the whole amount of the Order. No commissions, expenses or other amounts are deducted. The procedure for applying, the calculation of the amount and examples are given in the Refund Terms.
11.3. The Provider initiates the refund in the Payment Service no later than 3 calendar days from the day the request is received, so that the money is returned to the User no later than 7 calendar days from the day the request is received.
12. Quality, availability and liability
12.1. Properties of the Service. The Service is provided as far as technically possible. Its operation depends, among other things, on the network of the User's telecommunications operator, on the Device and on the connection application. The Service may be unavailable in particular communications networks and at particular times. The Provider does not promise a particular connection speed, uninterrupted operation or the availability of any particular websites and services.
12.2. Clause 12.1 describes the properties of the Service. It does not limit the User's rights or the Provider's liability established by law.
12.3. If the Service was unavailable, the User may, at the User's choice, receive an extension of the Access Term by the time of unavailability or a refund of the cost of that time. This rule does not apply if the Provider proves that the unavailability was caused by reasons on the User's side (the User's Device, the connection application, the Internet connection from the User's telecommunications operator) or by force majeure. Faults at hosting providers and other persons engaged by the Provider are reasons on the Provider's side. The time of unavailability is rounded up to whole days (сутки); the cost of those days is calculated in the same way as the cost of unused days (clause 3.2 of the Refund Terms); the refund is made within the time limit stated in clause 11.3. For this, the User contacts Support.
12.4. The User keeps all rights provided by consumer protection legislation, including the rights in case of a breach of the time limit for providing a service and where defects in a service are found (Articles 28 and 29 of the Consumer Protection Law). If any term of the Offer contradicts the law, the law applies.
12.5. The Provider is liable for non-performance or improper performance of the contract in accordance with the legislation of the Russian Federation.
12.6. The websites and services which the User reaches through the connection belong to third parties. Their content and operation do not depend on the Provider.
13. Personal data
13.1. The Provider processes the User's personal data to conclude and perform the contract and for the other purposes stated in the Policy. The set of data, the purposes, the grounds, the retention periods and the User's rights are described in the Policy.
13.2. Data are received by: the Payment Service (the amount and identifier of the Order, the name of Fortochka and of the Plan, the internal number of the User's account in Fortochka), the Telegram messenger (delivery of the Bot's messages and correspondence with Support) and the hosting providers from which the Provider rents servers (data are stored on those servers and transmitted through them). The full list of recipients is given in section 5 of the Policy. The Provider is responsible to the User for the processing of data on the rented servers.
13.3. The connection is established through servers outside the Russian Federation. Which data are processed on those servers and in which states is stated in section 6 of the Policy.
13.4. After the Access Term ends, the User's account (Telegram identifier and username, interface language, invitation information) is kept for 12 months so that the User can resume access. The User may demand that it be deleted earlier by contacting Support.
14. Messages and requests
14.1. The Provider sends the User, in the Bot chat, service messages connected with performance of the contract: about the Order, payment, the receipt and a refund, about the start and end of the Access Term, about the crediting and cancellation of Extra Days, about unavailability of the Service and a change of the connection details, about a change of the terms and the closure of Fortochka, about breaches and about suspension of access. The Provider sends no other messages in the Bot chat.
14.2. The User sends requests to the Provider through Support.
14.3. A request sent to Support by any of the ways stated in clause 1.14 is deemed received by the Provider on the day it is sent. If a request came from a Telegram account other than the one from which the Order was created, the Provider may ask the User to name the Order; the time limits for a reply and for a refund are still counted from the day of the first request.
14.4. If the User has lost access to the Telegram account from which the Order was created, the User may contact Support from another Telegram account or by e-mail, name the Order (its number, or the date and amount of the payment) and withdraw from the Service. The refund is made under the Refund Terms by the same method by which the payment was made.
15. Amendment and withdrawal of the Offer
15.1. The Provider may amend the Offer, the Plans and the Refund Terms by publishing a new edition on the Site with its date stated.
15.2. A new edition applies only to Orders created after it is published. Orders created earlier are governed by the edition in force when they were created (clause 3.3).
15.3. The Provider keeps earlier editions and provides them to the User on a request to Support.
15.4. The Offer is in force until the Provider withdraws it. Withdrawal of the Offer does not end the obligations under periods already paid for. If the Provider closes Fortochka before Paid Periods end, the Provider gives notice of this in the Bot chat and, without any request from Users, no later than 7 calendar days from the day Fortochka closes, returns the cost of the unused days by the formula in clause 3.2 of the Refund Terms; the User's right to compensation of losses remains.
16. Requests and dispute resolution
16.1. The relations of the parties are governed by the law of the Russian Federation.
16.2. The User may, but is not obliged to, send the Provider a request through Support before going to court. The Provider replies to a request within 10 calendar days from the day it is received.
16.3. Disputes are heard by a court in accordance with the legislation of the Russian Federation. The User may bring a claim, at the User's choice: in the court at the Provider's place of residence, at the User's own place of residence or stay, or at the place where the contract was concluded or performed (Article 17 of the Consumer Protection Law).
16.4. The Offer does not limit the User's right to apply to state bodies and to a court.
